Kvale receives Best Attorney Achievement Award 2016

The Norwegian Financial Newspaper “Finansavisen” has awarded Kale’s Employment Law Department with the award for Best Attorney Achievement 2016. The winner is selected based on votes from Norwegian law firms.

The award was given for the work Kvale performed in connection with winning the Holship-case before the Norwegian Supreme Court (plenary judgment) on December 16th 2016. The opposing parties were The Norwegian Confederation of Trade Unions, the Norwegian Transport Workers Federation and the State of Norway, represented by the Attorney General – Civil Affairs. By winning this case, Kvale succeeded in prohibiting the hundred year old monopoly on loading and unloading ships in Norwegian ports, which has been based on a long lasting collective agreement between The Norwegian Confederation of Trade Unions and the Confederation of Norwegian Business.

Nicolay Skarning, head of Kvale’s Employment Law Department and Norwegian Representative of The Employment Law Alliance says:

We are very happy to receive this award, but most importantly, winning this case will help the development and growth in Norwegian business within the transport sector. The stevedoring monopoly was a hinder for efficient business. Following the Supreme Court judgement this will no longer be a problem. The judgement is based on EU Law and by consequence the decision may have impact in a lot of other European jurisdictions as well where one still finds stevedoring monopolies”
